Driveway Planning Permission Rules
Since 2008, there have been specific rules about hard surfacing front gardens in England. Here is what you need to know.
When You DO NOT Need Planning Permission
You can install a driveway without planning permission if:
Using permeable materials:
- Permeable block paving
- Gravel or shingle
- Permeable resin bound
- Grass reinforcement grids
Using non-permeable materials with drainage:
- Water drains to a lawn or border (not the road)
- Water goes to a soakaway on your property
- Surface is less than 5 square metres
When You DO Need Planning Permission
Planning permission is required if:
- Using non-permeable materials over 5m² that drain to the road
- Your property is listed or in a conservation area (may need permission regardless)
- You are creating a new access onto a classified road

The regulations aim to reduce flood risk by ensuring rainwater soaks into the ground rather than overwhelming drains and increasing flood risk downstream.
